Legal Defense for Probation Violations
What constitutes a Probation Violation in Michigan?
Probation allows individuals to serve their sentences outside of jail under specific conditions. However, violating these conditions can lead to severe consequences. A probation violation occurs when an individual fails to comply with the terms set by the court. Common ways a probation violation can happen include:
- Failing to appear in court or meet with a probation officer
- Committing another crime while on probation
- Failing drug or alcohol tests
- Not completing court-ordered programs or community service
- Traveling out of state without permission
- Failing to pay fines or restitution
Learn how Probation Lawyer Mark Caldwell can help you navigate your probation violations!

This is attorney Mark Caldwell and I’d like to discuss with you your options if you have a probation violation. If you have a probation violation it’s usually because you’ve tested positive for drugs and alcohol, you failed to do community service. Failed to pay your fines or you’ve failed to comply with any other condition of your probation.
Now the first court date you’ll have after the violation will be a probation violation arraignment. At that arraignment you can either plead guilty or not guilty. If you plead guilty then at that time judge will sentence you and that judge can sentence you to jail with extended probation, with probation terminating, or keeping probation the same.
If you plead not guilty then it gives me an opportunity to discuss the case with your probation officer and find out what their recommendations are. Seeing if they’re willing to do anything different than their recommendations and try to work out a deal for you.
If you’re on a deferment and you have a violation and usually a deferment would be for like a domestic violence case. If you complete your terminal probation the charge will go away, however if you violate probation, typically you’ll lose that deferment. If you have any more questions you can call me you can email me you can text me or you can find out more information on my website.
Penalties for probation violations can vary significantly based on the severity of the violation and your criminal history. They may include extended probation, additional fines, mandatory treatment programs, or even jail time.
